Our Terms of Service
We are Keep On Roaming Ltd ('Company', 'we', 'us', or 'our'), a company registered in England and Wales at 2 Winchester Place, North Street, Poole, England BH15 1NX.
Keep On Roaming® provides Roam Like Home® eSIM solutions, revolutionising connectivity for modern-day travel. We eliminate the need for physical SIM cards and offer seamless access to high-speed data in over 190 countries and territories.
These Terms of Service ('Terms') apply to your access to and use of our eSIMs and related connectivity and support (the 'Services'), which you can buy and manage through our website https://www.keeponroaming.com (the 'Site') and the Keep On Roaming mobile application (the 'App'). Together the Site and the App are our 'Platform'.
By creating an account (an 'Account'), buying a plan, or otherwise using the Services, you agree to these Terms, our Privacy Policy, Cookie Policy, Fair Use Policy and Acceptable Use Policy, which together form the agreement between you and us. If you do not agree to them, you must not use the Services.
The Services are intended for users who are at least 18 years old. Persons under the age of 18 are not permitted to use or register for the Services.
We may update these Terms from time to time. Where changes are material, we will take reasonable steps to let you know, for example by updating the 'Last updated' date at the top of this page or by contacting you. Your continued use of the Services after an update means you accept the revised Terms.
Using the Services
To use an eSIM you need an unlocked, eSIM-compatible device with a supported operating system. It is your responsibility to check that your device is compatible before you buy. Coverage, supported networks and speeds vary by destination and depend on the underlying mobile networks.
Your Account is personal to you and is not transferable. You are responsible for keeping your login credentials secure and for all activity that takes place through your Account. You must tell us straight away if you think your Account has been accessed without your permission.
We may suspend, restrict or terminate your Account or access to the Services where we reasonably believe there has been a security concern, or a breach of these Terms, our Fair Use Policy or our Acceptable Use Policy.
Pricing and payment
Prices for the Services are shown on the Platform in the currency displayed at checkout (for United Kingdom customers, this is pounds sterling (GBP)). Prices may include or exclude taxes depending on your billing address; any applicable taxes will be shown before you pay.
You agree to provide current, complete and accurate payment information. Payment is taken at the time of purchase through our third-party payment providers. By buying a plan you authorise us (and our providers) to charge your chosen payment method for the total amount, including any taxes.
Refunds
This section explains when you are entitled to a refund. It applies only to plans bought directly from Keep On Roaming.
Your legal right to cancel. As a consumer, you have the right to cancel your purchase within 14 days without giving a reason under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. However, because an eSIM is digital content supplied immediately, this right ends once the eSIM has been activated. By activating your eSIM within the 14-day period you acknowledge that you lose your right to cancel.
Refunds where something goes wrong. If an error on our side prevents you from using a plan you have bought, you may be entitled to a replacement or a refund, provided that:
- you request it within 30 days of purchase;
- we are unable to restore access within a reasonable period after you report the problem; and
- you cooperate with us so we can investigate.
Partial credit. Where a refund is due for a plan that has been partly used, it will cover only the unused portion of the Services.
How refunds are issued. Submit a request through your Account or by contacting us at [email protected]. Approved refunds are issued as Roam Credits to your rewards wallet by default, which you can spend on future purchases straight away. If you would prefer, you may instead choose to be refunded to your original payment method, and we will process this within 30 days of approving your refund.
Unauthorised or incorrect charges. If you believe a charge was not authorised, or was incorrect, contact us within 30 days. We will investigate and decide, acting reasonably, whether a refund is due.
Intellectual property
We (or our licensors) own all intellectual property rights in the Platform and the Services, including the Keep On Roaming® and Roam Like Home® trade marks, and all related software, text, graphics and designs. Nothing in these Terms transfers any of those rights to you. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Platform and the Services for your own personal use in line with these Terms.
If you send us feedback or suggestions, you agree that we may use them without any obligation or payment to you, and that we will not be treated as having any confidentiality obligation in respect of them.
Third-party websites and content
The Platform may link to websites, apps or content operated by third parties. We do not control and are not responsible for those third parties, and your use of them is governed by their own terms and policies.
Disclaimer
The Services and the Platform are provided on an 'as is' and 'as available' basis. In particular, we do not guarantee that they will be available at all times, nor do we guarantee the quality of the underlying connections and networks. To the extent permitted by law, we exclude all implied conditions, warranties, representations or other terms that may apply to the Services or the Platform.
Limitation of liability
Except where restricted by law, in no event will we be responsible to you for any indirect, consequential, exemplary, incidental or punitive damages, including lost profits, even if we have been advised of the possibility of such damages.
To the extent that we fail to comply with these Terms, we will be responsible for the loss and damage you suffer that is a foreseeable result of our breach, but our and our affiliates' total aggregate liability to you in any circumstances is limited to USD 100.00 (one hundred US dollars).
Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, including for death or personal injury caused by our negligence or for fraud.
Indemnity
To the extent permitted by law, you will indemnify us and our directors, officers, employees and contractors for any third-party legal proceedings (including actions by government authorities) arising out of or relating to your unlawful use of the Services or your breach of these Terms.
Governing law and jurisdiction
These Terms and any dispute or claim arising out of or in connection with them are governed by the laws of England and Wales. You and we agree that the courts of England and Wales have exclusive jurisdiction to settle any such dispute. Any dispute will be resolved on an individual basis, and you agree not to bring or participate in any class, collective or representative action.
General
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force. Our failure to enforce any right does not waive it. These Terms are the entire agreement between you and us in relation to the Services.
